Dear Charles,
"In a Democracy, Sovereignty lies with the People" which means that Common
Law, being made by the People on Juries, overrules anything a Parliament
might want to impose, such as Statute Law. For a "Family Court" to be a
Court, there must be Juries empanelled for every action unless both parties
give their consent not to have one (a Jury, that is).
