Feminists have convinced some of us that equal protection was always
meant to apply to women, or even that it is the reason the Constitution
exists. With this assumption behind them, Patricia Ireland now says:
Many Christian pastors and activists think the gospel's
message is that women and men are equal in the sight of God,
that
women should exercise God-given free will over our own lives
and that
none of us needs the Promise Keepers's high priests pressing
their
fundamentalist political agenda. This is a bald faced lie and Patricia Ireland will never find a single
scripture in the Bible to support that statement. The Bible describes
a workable family structure with the father as the head of the family,
and Patricia Ireland the homosexual stands for just the opposite.
If she continues to misquote Biblical scripture, what makes her so sure
we wont ultimately apply it properly in dealing with her?
The Fourteenth Amendment which contains the phrase equal protection
was ratified in 1868--almost 130 years ago--with the intent of giving newly
freed slaves citizenship and not to undermine family structure by providing
women equal protection. The Fifteenth Amendment was ratified
in 1870 and gave slaves but not women the vote. If either amendment
was meant to apply to women, either would have specifically stated so (and
they probably would not have been ratified), but neither one did and women
did not have the vote nor did the term equal protection apply to women
at the time these amendments were ratified. People at the time were
very sensitive about the role of women described in the Bible which was
protected under the First Amendment right to free exercise [of religion].
THE COURT HELD IN THE 1874 TERM THAT A STATE COULD CONSTITUTIONALLY
RESTRICT THE FRANCHISE TO MEN. WHILE THE FOURTEENTH AMENDMENT WAS
RELIED UPON, THE THRUST OF THE OPINION WAS DIRECTED AT THE PRIVILEGES AND
IMMUNITIES CLAUSE WITH A SUBSIDIARY REFERENCE TO THE DUE PROCESS CLAUSE,
MINOR V. HAPPERSETT, 21 WALL. 162. This ruling makes it clear that the equal protection clause did not apply
to women after ratification of the Fourteenth Amendment and at least until
ratification of the Nineteenth Amendment. But even the Ninteenth
Amendment which gave women the right to vote in 1920 did not apply the
term equal protection to women:
WHEN THE NINETEENTH AMENDMENT WAS RATIFIED GIVING WOMEN THE RIGHT TO
VOTE, IT WAS ASSUMED BY MOST CONSTITUTIONAL EXPERTS THAT THERE WAS NO RELIEF
BY WAY OF THE EQUAL PROTECTION CLAUSE OF THE FOURTEENTH AMENDMENT, Justice
Douglass, Oregon v. Mitchell, 400 US 112 (Dec. 21, 1970) Thus it is clear that even giving women the right to vote in 1920 still
did not apply the term equal protection to women. To do so would
have undermined one of the most important tenets of the religions of 86%
of North Americans--establishment of the father as the head of the family.
It would have violated the spirit and intent of those who ratified the
Fourteenth Amendment. It would have broken with 130 years of Constitutional
tradition. And now we know--it would have caused social chaos:
IT WAS MUCH LATER, INDEEDNOT UNTIL THE 1961 TERM-- NEARLY A
CENTURY AFTER THE FOURTEENTH AMENDMENT WAS ADOPTED-- THAT DISCRIMINATION
AGAINST VOTERS ON GROUNDS OTHER THAN RACE WAS STRUCK DOWN, Justice Douglass,
Oregon v. Mitchell, 400 US 112 (Dec. 21, 1970). AND NOW YOU KNOW, GENTLEMEN. Without a mandate from we the people,
without the required Constitutional amendment, without regard to the very
important precepts of the First Amendment right to free exercise [of religion],
contrary to 161 years of Constitutional tradition, and quixotically reversing
93 years of consistent support of the spirit and intent of we the people
through the Fourteenth Amendment, these judicial activists suddenly changed
courses on us, and created social havoc in the process:
Since the 1960s:
The divorce rate more than doubled.
The murder rate tripled while the solution rate for murders declined
from 92% to 63%.
The value of the dollar declined almost to a quarter of its previous
value by the Consumer Price Index and by 10 times by the gold standard
(from $38/oz to $380/oz).
More has been spent on welfare than the entire asset value of every
Fortune 500 corporation and every acre of farm land combined.
The percent of the world's autos supplied by the U.S. declined from
60% to 20%.
The prison population increased four fold to a rate 5 times that of
China who we accuse of human rights abuses.
The average weight of an American increased 25 pounds.
SAT scores declined 98 points.
The percent of fatherless children increased from 17.5% to 39%.
Since the 1970s:
GDP per worker declined 70% by the gold standard.
The savings rate dropped to less than 2% (versus 25% in Japan).
The public debt increased 8 fold making the U.S. is the largest debtor
nation in world history.
Even with more than 1.6 million abortions each year and "the pill"
the illegitimacy rate still increased five fold.
Cocaine use rose 45% in spite of the world's strictest"drug war".
Criminal justice system expenditures increased 10 fold and now exceed
the budget for national defense.
The trade deficit increased from being in the black to $123 Billion
in the red.
Government spending as a percent of the average American's income exceeds
42% and is rising, compared to 27% in Japan and 32% in the U.S. 3 decades
ago.
Drunk driving arrests are up 5 fold while the motor vehicle fatality
rate increased from 30% lower than Germany's to 45% higher in the same
period.
Health services costs are up 8 fold and just the paperwork required
to meet government regulations costs 3% of GDP.
The amount of time PER DAY that children watch TV increased from 5
hours to 7 hours
The number of the world's Top 50 Banks which were U.S. declined from
22 to only three (with assets of $570 Billion while 24 are Japanese with
assets of $12,000 Billion)
The number of lawyers increased to 70 times more than Japan (while
Japan has 4 times as many engineers).
The ratio of manufacturing employees to government employees declined
from 2.5:1 to less than 1:1.
Total US "Personal Savings" are $212 Billion while Japan has $22,000
Billion (that is $22 Trillion) just in their "Postal Savings Account".
"a 560% increase in violent crime, a 419% increase in illegitimate
births, a 3000% increase in single-parent households, and a drop of almost
