 | Mont. Rev. Code Ann. 36102 (1947):
Rights of husband as head of family.
"The husband is the head of the family. He may choose any reasonable place or mode of
living, and the wife must conform thereto."
For 2,000 to 5,000 years it was understood by hundreds
of millions of Christians worldwide that the father is the
head of the family, so what changed in 1973 that caused men and women to both view this
role differently?
"Many of these early
laws were repealed
or amended in direct response to the passage of the Equal Rights Amendment in 1972. See,
e.g., 1973 N.M. Laws, ch. 58, 1 (revising the definition of "unlawful
discriminatory practice" under the New Mexico Human Rights Act, NMSA 1978, 28-1-7
(1995), to expand prohibitions on sex discrimination)"
"The state statute alleged to have been drawn in question by
appellant as repugnant
to the Due Process Clause of the Fourteenth Amendment to the Constitution of the
United States was 7996 of the Ohio General Code of 1910 providing that "The husband
is the head of the family. He may choose any reasonable place or mode of living, and the
wife must conform thereto." The Probate Court was said to have upheld that section as
establishing the legal domicile of the children with their father and, on that basis, to
have upheld the Wisconsin decree as validly depriving their mother of her custody over her
children, although the Wisconsin court never obtained personal jurisdiction over
her."
The California Family Law Act of
1970
If American men were familiar with the "family
law" they are subjected to upon marriage, they would never, ever apply for a
"marriage license". This "family law" doesn't even pass the
first stage of the smile test--no lawyer in the land can look in the mirror and think
about any section in the "family law" without seeing himself smile. The
passage of this law in 1970 caused an immediate 38.5% jump in the number of divorces in California, more divorces than there had been
marriages just 9 years earlier, in 1961.

7883. If a person personally served with a citation
within this state as provided in Section 7880 fails without reasonable cause to appear and
abide by the order of the court, or to bring the child before the court if so required in
the citation, the failure constitutes a contempt of court.
7884. (a) Unless requested by the child concerning
whom the petition has been filed and any parent or guardian present, the public shall not
be admitted to a proceeding under this part. (b) Notwithstanding subdivision (a), the
judge may admit those persons the judge determines have a direct and legitimate interest
in the particular case or in the work of the court.
This is in direct contravention to the US
Constitution and its amendments which state:
AMENDMENT I
Congress shall make no law respecting an establishment of religion,
or prohibiting the free exercise thereof
AMENDMENT VI
In all criminal prosecutions, the accused shall enjoy the right to a
speedy and public trial, by an impartial jury of the State and
district wherein the crime shall have been committed, which district
shall have been previously ascertained by law, and to be informed of
the nature and cause of the accusation; to be confronted with the
witnesses against him; to have compulsory process for obtaining
witnesses in his favor, and to have the assistance of counsel for his
defense.
17522. (a) Notwithstanding any other law, if any
support obligor is delinquent in the payment of support for at least 30 days and the local
child support agency is enforcing the support obligation pursuant to Section 17400, the
local child support agency may collect the delinquency or enforce any lien by levy served
on all persons having in their possession, or who will have in their possession or under
their control, any credits or personal property belonging to the delinquent support
obligor, or who owe any debt to the obligor at the time they receive the notice of levy.
AMENDMENT V
No person shall be held to answer for a capital, or otherwise
infamous crime, unless on a presentment or indictment of a Grand Jury,
except in cases arising in the land or naval forces, or in the
militia, when in actual service in time of war or public danger; nor
shall any person be subject for the same offense to be twice put in
jeopardy of life or limb; nor shall be compelled in any criminal case
to be a witness against himself, nor be deprived of life, liberty, or
property, without due process of law; nor shall private property be
taken for public use without just compensation.

Algeria
Family Code
The real battleground over the status and rights of women has been the family code, a
set of legal provisions regulating marriage and the family. Debated between those who
wanted family life organized along Western secularist lines and those who favored a family
structure conforming to Islamic principles and ethics, the code was proposed, discussed,
and shelved at least three times over a period of two decades before being adopted into
law in 1984. In one instance, in 1981, the code's provisions provoked vehement opposition
from female members of the National People's Assembly and street demonstrations by women
in Algiers, both almost unprecedented events in Algeria.
Although some of the 1984 code's provisions are more liberal than those of the 1981
version, the code essentially reflects the influence of Islamic conservatives. The family
unit is "the basic unit of society"; the head of the family is the husband, to
whom the wife owes obedience. According to the sharia, a Muslim woman may not marry a
non-Muslim; polygyny is permitted under certain conditions (although it is rarely
practiced); and women do not inherit property equally with men. A woman cannot be married
without her consent, and she may sue for divorce in specified circumstances, including
desertion and nonsupport. Custody of children under age seven in divorce cases passes to
the wife but reverts to the husband when the children are older. Divorce rates have risen
steadily since independence, but divorce remains much easier for men than for women.

Dear
Listener's and Supporter's:
Well as most of you already know, Chief Justice Roy Moore's trial is tomorrow Wednesday,
November 12, 2003. Please be in much prayer for this trial. The
Re-Taking America team will be leaving this afternoon for Montgomery. Kelly has
filed another lawuit as of yesterday, because the Court of
Judiciary is unconstitutional and it was not in our 1901 Alabama constitution and it was
deceptfully put in 1973 without a vote of the people. I hope that you have made calls to the members of the Court of
Judiciary to let them know that we want our 1st amendment held up and that we do not want
our election of Chief Justice Roy Moore overturned. There is an Alabama Save The Ten
Commandment Rally in Mobile today, Tuesday, November 11, 2003. The rally will be at
First Baptist Church of Tillman's Corner, 5660 Three Notch Road, Mobile, Alabama.
4:30 p.m. Pastor's Briefing
5:30 p.m. News Conference
6:30 P.M. Prayer Rally
I hope that you will make plans to attend this rally. You may also
plan to come to Montgomery and make a stand outside the Alabama Judicial Building, 300
Dexter Avenue, where the trial will be held. They are only allowing 200 people in,
but they are calling for those to come and make a stand outside the building in support
and to pray! In Montgomery, Alabama on Wednesday, November 12, 2003:
8:00 a.m. News Conference Alabama Judicial Building
300 Dexter Avenue
2:00 p.m. Pastors Briefing Taylor Road Baptist Church
1685 Taylor Road
4:00 p.m. News Conference Alabama Judicial Building
6:30 p.m. Prayer Rally Heritage Baptist Church
1849 Perry Hill Road
You might be asking "What can I do to help in this battle of Truth?" You
may be one that can pray, or you may be one that can come to Montgomery and make a stand,
or you may be one that can help financially. If you like what Re-taking America
stands for -TRUTH, please prayerfully consider supporting our cause!
